What is Mediation?
One way to avoid costly, and often ugly, litigation is to seek an agreement through mediation. Mediation is an informal process in which a neutral person conducts discussions among the disputing parties designed to enable them to reach a mutually acceptable agreement among themselves. Rule 31 mediation is based on principles of communication and negotiation that emphasize the needs and interests of the parties. Since the decision-making authority rests with the parties, mediation is a great way to resolve a dispute without the need for litigation.
The Many Benefits of Mediation:
Mediation is alternative dispute resolution that has been so successful in divorces over the years that Tennessee now requires that individuals mediate their divorce prior to receiving a trial date. Mediation has a number of distinct benefits as compared to litigation including:
- Parties have greater control of the divorce process and outcome
- Mediation gives parties a shorter time table for making decisions
- Parties can make decisions jointly rather than turning all decisions over to a judge
- Parties often enjoy greater flexibility in arrangements
- Mediation is generally less expensive than trial
